General Litigation

The General Litigation Section represents the State, its officials, and employees in the following types of legal matters:

• Tort Claim Lawsuits - Lawsuits brought against the State alleging the State was negligent in some manner are defended by the attorneys in the General Litigation Section.

• Workers' Compensation Suits - Employees of the State of Nebraska are covered by Nebraska's Workers' Compensation Act. If a dispute arises over the compensation to be paid under the Act, attorneys in the General Litigation Section defend the State against the employee. Attorneys in the General Litigation Section also represent the Workers' Compensation Trust Fund, and bring actions against employers who violate the Act.

• Administrative Procedures Act Suits - In certain situations, State employees may appeal agency decisions to a district court judge. In these Administrative Appeals, the attorneys in the General Litigation Section represent the Agency and its officials.

• Employment Discrimination and Civil Rights Claims - State employees are protected by federal and state anti-discrimination laws, and federal civil rights laws. Attorneys in the General Litigation Section defend the State, its agencies, and officials, against lawsuits alleging a violation of these laws. Attorneys in the General Litigation Section also assist the Nebraska Equal Opportunity Commission in the enforcement of the Nebraska Fair Housing Act, the Act Prohibiting Unjust Discrimination Because of Age, and the Act Providing Equal Enjoyment of Public Accommodations.

• Miscellaneous Civil Litigation - There are other areas of civil litigation involving the State not mentioned above. Attorneys in the General Litigation Section represent the State in all civil litigation where the State has an interest.
