Civil Litigation Bureau

The Civil Litigation Bureau handles most of the state's tort claims, workers' compensation cases, employment disputes, Health and Human Services Litigation and includes the Inmate Litigation Section. Attorneys in the Civil Litigation Bureau appear regularly on behalf of the State of Nebraska in state and federal courts at both the trial and appellate level.


Litigation

General Litigation

The General Litigation Section represents the state, its officials and employees in the following types of legal matters:

  • Tort Claim - Lawsuits brought against the state alleging some manner of negligence.
  • Workers' Compensation - Employees of the State of Nebraska are covered by Nebraska's Workers' Compensation Act. If a dispute arises over the compensation to be paid under the Act, attorneys in the General Litigation Section defend the state. Included in this section is the Worker’s Compensation Trust Fund, which brings actions against employers who violate the Act.
  • Administrative Procedures Act - State employees may appeal agency decisions to a district court judge. This office represents the agency and its officials.
  • Employment Discrimination and Civil Rights Claims - State employees are protected by federal and state anti-discrimination laws and federal civil rights laws. This also includes the Nebraska Equal Opportunity Commission.
  • Inmate Litigation - This section defends the state against civil lawsuits filed by inmates. These actions are filed under the State Tort Claims Act, the Federal Civil Rights Act and the Administrative Procedures Act.

Equal Opportunity Commission

The Attorney General's office reviews and determines whether to litigate complaints referred by the Nebraska Equal Opportunity Commission. These complaints may include allegations of violations of any of the following:

  • Nebraska Fair Housing Act
  • Act Prohibiting Unjust Discrimination in Employment Because of Age
  • Act Providing Equal Enjoyment of Public Accommodations
